Terms of Use

1. Purpose

These General Terms of Use (hereinafter "Terms") define the conditions of use of the eikonia-app.com website and Eikonia software (hereinafter "the Service"). By accessing the website or using the software, you unreservedly accept these Terms. If you do not accept these conditions, please do not use the Service.

2. Definitions

• "Publisher": Nicolas Jacquet, publisher of the website and Eikonia software • "Service": the eikonia-app.com website and Eikonia software • "User": any person accessing the website or using the software • "Software": the Eikonia desktop application for photo sorting and protection • "Subscription": the software usage license subscribed to by the User

3. Service Description

Eikonia is a desktop software (Windows and macOS) that enables: • Automatic photo organization and sorting via facial recognition • Identification and tagging of sensitive individuals • Filtering and exporting of photos • Automatic face blurring The software operates entirely locally on the User's computer. No photos or facial recognition data are transmitted to our servers. The website enables registration for our waiting list and beta program, as well as subscription purchases.

4. Access to the Service

Access to the website is free and open to everyone. Use of the Eikonia software requires a paid subscription, except under the beta program where free access may be granted. The Publisher reserves the right to suspend or discontinue access to the Service for maintenance, updates, or in cases of force majeure, without this giving rise to compensation.

5. Registration and User Account

To register for the waiting list or subscribe, the User must provide a valid email address. The User agrees to: • Provide accurate and up-to-date information • Maintain the confidentiality of their login credentials • Immediately notify the Publisher of any unauthorized use of their account The User is solely responsible for the use of their account.

6. Subscription and Payment

Use of the Eikonia software is subject to a paid subscription. Prices are listed on the website in euros (EUR), inclusive of all taxes for individuals residing in Belgium. The applicable VAT depends on the User's country of residence. Payment is made by credit card or any other payment method offered on the website. The subscription is automatically renewed at each term, unless canceled by the User. Billing is managed by Productions Associées (BE 0896.755.397).

7. Right of Withdrawal

In accordance with the Belgian Economic Law Code and EU Directive 2011/83/EU, consumer Users have a 14-day period from the date of subscription to exercise their right of withdrawal, without having to justify reasons or pay penalties. However, in accordance with Article VI.53, 13° of the Economic Law Code, the right of withdrawal cannot be exercised for digital content supplied on a non-tangible medium where performance has begun with the consumer's prior express agreement, who also acknowledged losing their right of withdrawal. 8. Termination

The User may cancel their subscription at any time from their personal space or by contacting support. Cancellation takes effect at the end of the current subscription period. The Publisher may terminate a User's subscription in the event of: • Non-payment of subscription • Violation of these Terms • Fraudulent or abusive use of the Service In the event of termination due to User fault, no refund will be made.

9. License of Use

The Publisher grants the User a personal, non-exclusive, non-transferable, and revocable license to use the Eikonia software for the duration of the subscribed subscription. This license allows the User to install and use the software on their own computers for personal or internal professional use. Any other use, including resale, rental, sublicensing, or distribution of the software, is strictly prohibited.

10. Intellectual Property

The Eikonia software, website, their content (texts, images, logos, etc.) and source code are protected by intellectual property rights and belong exclusively to the Publisher. The User agrees not to: • Copy, modify, adapt, or translate the software • Disassemble, decompile, or reverse engineer the software • Remove or modify intellectual property notices • Use trademarks or logos without prior written authorization

11. User Responsibilities

The User agrees to: • Use the Service lawfully and in accordance with these Terms • Not use the Service for illegal or unauthorized purposes • Respect the rights of third parties, including the right to privacy and image • Not attempt to circumvent the security or protection measures of the Service • Ensure they have the necessary authorizations to process photos of third parties The User is solely responsible for their use of the software and the photos they process. The Publisher cannot be held liable for use that does not comply with image rights or personal data protection laws.

12. Limitation of Liability

The software is provided "as is". The Publisher does not guarantee that the software will be error-free or operate without interruption. The Publisher cannot be held liable for: • Indirect, incidental, or consequential damages • Loss of data, profits, or business opportunities • Damages resulting from the use or inability to use the Service • Damages caused by viruses or other harmful elements The Publisher's total liability is limited to the amount actually paid by the User during the last 12 months. These limitations do not apply in cases of intentional misconduct or gross negligence by the Publisher.

13. Legal Warranty

In accordance with the Belgian Economic Law Code, consumer Users benefit from the legal warranty of conformity for digital content and services. In the event of a lack of conformity, the User is entitled to have the digital content or service brought into conformity, or to a price reduction or contract termination under the conditions provided by law.

14. Personal Data

The processing of personal data is governed by our Privacy Policy, available at: /en/privacy-policy The User acknowledges having read this policy before using the Service.

15. Changes to Terms

The Publisher reserves the right to modify these Terms at any time. Users will be informed of modifications by email or via the website. Continued use of the Service after notification of modifications constitutes acceptance of the new Terms. In case of disagreement with the new conditions, the User may cancel their subscription in accordance with the "Termination" section.

16. Applicable Law and Disputes

These Terms are governed by Belgian law. In the event of a dispute, the parties agree to seek an amicable solution before taking legal action. Failing an amicable agreement, the courts of Brussels shall have jurisdiction for any dispute relating to the interpretation or performance of these Terms. For consumers residing in the European Union, it is also possible to use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr

17. Miscellaneous Provisions

If any provision of these Terms is found to be null or unenforceable, it shall be deemed unwritten, without affecting the validity of the other provisions. The Publisher's failure to enforce any breach by the User of any of their obligations shall not be construed as a waiver of the obligation in question.
